(1) If there is a bilateral treaty between Nepal and a foreign state regarding the exchange of mutual legal assistance, mutual legal assistance can be exchanged between Nepal and such a foreign state.
(2) Notwithstanding anything contained in sub-section (1), in relation to a specific judicial proceeding, a foreign state shall provide legal assistance on the basis of reciprocity if it requests mutual legal assistance through diplomatic channels to the Government of Nepal, assuring that it will provide mutual legal assistance in future similar judicial proceedings. There will be no hindrance. However, the decision made by the foreign court cannot be enforced in the case of non-treaty.
